Rules for using SelfDriveStories, providing electronic services, and intermediating in arranging 4x4 vehicle rentals in Namibia.

1. General provisions
These Terms set out the rules for using the website available at www.selfdrivestories.com (the "Website") and for providing services by electronic means, in accordance with the Polish Act of 18 July 2002 on providing services by electronic means. The Website is operated and owned by the entity identified above in the "Service Provider" section (the "Service Provider" or "SelfDriveStories"). Using the Website constitutes acceptance of these Terms.
2. Definitions
- Website - the SelfDriveStories website with its subpages and features.
- User - any person using the Website.
- Consumer - a natural person acting for purposes outside their trade, business, or profession.
- Partner - an external provider of on-site services, in particular the rental of 4x4 vehicles in Namibia (e.g. Melbic (melbic.com)).
- Own services - services provided directly by SelfDriveStories (e.g. advice, route-planning assistance, organisation, Polish-language support, welcome pack).
- Intermediation - connecting the User with a Partner and assisting in arranging the rental.
- Rental agreement - the vehicle rental agreement concluded separately between the User and the Partner/lessor.
3. Types and scope of services
The Website is informational and presents trips and 4x4 vehicle rentals in Namibia and South Africa. The Service Provider offers, by electronic means: access to content and fleet descriptions, a contact (inquiry) form, a virtual tour, and downloadable materials.
SelfDriveStories operates a mixed model:
- Own services - provided by SelfDriveStories itself, for which it is liable under general rules.
- Rental intermediation - SelfDriveStories connects the User with a Partner and assists in arranging the rental. The Rental agreement is concluded separately between the User and the Partner/lessor and governs the rental terms, price, deposit, insurance, and the scope of liability for the vehicle and the course of the rental.
SelfDriveStories is not a party to the Rental agreement concluded with the Partner, unless expressly agreed otherwise in writing.
4. Technical requirements
Using the Website requires: a device with Internet access, an up-to-date browser supporting JavaScript and cookies, and - for contact - an active email account. The Service Provider is not liable for issues resulting from the User not meeting these requirements.
5. Rules of use
Users must use the Website lawfully and in good faith, without submitting unlawful content. Interfering with the Website, automated overload attempts, attempts to bypass security, and actions violating security or third-party rights are prohibited.
6. Inquiries and booking process
Sending a message via the form or email constitutes an inquiry / request for an offer and is neither an offer within the meaning of the Civil Code nor the conclusion of a contract. The Website does not process online payments. Details (price, dates, payment terms, deposit, scope of liability) are agreed individually and confirmed off-site - by email and/or in a contract - with the Service Provider and/or Partner. Only terms confirmed in writing or by email are binding, not the content presented on the Website.
7. Prices and payments
Price information on the Website is indicative and illustrative, may change, and does not constitute an offer. The binding price results from individual confirmation. Settlements take place off-site, as agreed by the parties and - for the rental - under the Rental agreement concluded with the Partner.
8. Liability
The Service Provider provides services with due care and makes reasonable efforts to keep Website information up to date but does not guarantee full completeness or uninterrupted availability. The Service Provider is liable for the proper performance of its Own services under general rules.
To the extent permitted by law, the Service Provider is not liable for: non-performance or improper performance of the Rental agreement by the Partner, the technical condition of the Partner's vehicles, or events occurring during the trip or rental that fall outside the scope of the Own services. Claims related to the vehicle rental should be directed to the Partner under the Rental agreement.
The above limitations do not exclude or limit the Service Provider's liability to the extent that mandatory legal provisions - including consumer protection law - do not allow it.
Website content does not constitute legal, medical, or insurance advice. Users are responsible for ensuring valid documents (including a driving licence and, where required, an international driving permit), travel insurance, and for meeting the entry and health requirements of the destination country.
9. Complaints
Complaints about electronic services and Own services may be submitted by email to contact@selfdrivestories.com. Please describe the issue and provide contact details. A response is provided without undue delay, usually within 14 days. Complaints regarding the rental or vehicle itself should be directed to the Partner under the Rental agreement - we are happy to help establish contact.
10. Consumers and dispute resolution
Contracts are not concluded via the Website. Any consumer rights, including the right of withdrawal, arise from separate agreements concluded with the Service Provider or Partner and from applicable law, in particular the Polish Act of 30 May 2014 on consumer rights. Please note that for services related to leisure, transport, or services provided on a specific date, the right of withdrawal may not apply (Art. 38 of the Consumer Rights Act).
Consumers may use out-of-court complaint and redress procedures, including the EU ODR platform at https://ec.europa.eu/consumers/odr.
11. Intellectual property
The content, images, descriptions, layout, and graphics of the Website are protected by copyright and belong to the Service Provider or are used with the rights holders' consent (including Partner materials, e.g. Melbic (melbic.com), used with consent). Copying, distributing, or using materials without consent is prohibited unless permitted by law.
12. Personal data
The rules on personal data processing and cookies are described in the Privacy Policy.
13. Final provisions
Matters not covered by these Terms are governed by Polish law. These Terms may be updated, especially due to changes in the offer, Website features, or law; the current version is published on this page and applies from the moment of publication. Inquiries sent before a change are subject to the version in force at the time they were sent. If any provision of these Terms is found invalid or ineffective, this does not affect the validity of the remaining provisions.
